News Reporter, "This morning we have a special programme outside of Shanghai City Courtroom detailing the case of Mia James a famous Mental Health Clinician which was assaulted and stabbed inside of her clinic by the well-known CEO of James Industries. Sam James along with two other culprits will be judges for their crimes and may be facing life imprisonment depending on the verdict. News just in that the CEO of Shijie Li industries Aiden Li will be sitting the case being the man who saved the injured woman from the scene. We will be bringing you live coverage of the case so stay tuned for an exciting case.
Today was the day Mia would be facing Sam for the first time since that night, news reporters had swarmed the court exciting the nearby businesses and people which were also standing outside of the court awaiting the case of the century. It was so erratic due to the mention of two very famous Company director's involvement as well as the involvement of a female mental health worker which was very unheard of in Shanghai. Questions and speculation were thick in the air along with some very strong opinions of Mia. Some say she faked the whole thing for the money whereas others majority women supported her strongly against male sexual harassment.
Yu, "Wow this place is insane." Yu was a supporting factor but grew nervous seeing the camera flashes through the window. Publicity was terrifying for someone who had never been in the spotlight. Mia wasn't saying very much at all, she seemed oddly focused ignoring the paparazzi. This was to be expected of her case, there was nothing she could do about it so she may as well sit back and relax. Aiden held her hand the whole time with his face stone cold, he was used to publicity and knew many people would be itching to monopolize him but that didn't matter his girlfriend was the only thing that was of importance.
Aiden, "I'll park round back but if anyone ambushes you while I'm gone you say no comment okay?" Mia nodded; she knew the plan he'd drilled it into her head the whole car ride. Mika was also coming as a supporter which only attracted more publicity. Finally, was her mother who had been called for witness, Mia hated the fact they needed to bother her, but Aiden assured her that if Jane gave testimony their chances would increase of taking his down. As they were led by police to the private carpark, Aiden kissed her before walking round to the front. Mia was so grateful for him; he'd basically offered himself up for sacrifice so Mia could go into court stress free. Everything was so loud she couldn't concentrate at all. Luckily Yu had her covered and held her hand as they entered the courthouse.
The building was huge and filled with oak benches and chandeliers, she could tell this was for the rich only. Little business holders like her would usually resolve matters in a one room court on the outskirts and truthfully, she regretted doing in such a public place. Yu and Mia sat down outside the courtroom with some coffee and sat in silence. Their emotions were sky high right now and Mia felt sick to her stomach.
Yu, "It's going to be okay Mia, in a few hours this will all be over, and you can move on with your life. We've got you." Mia leaned her head on Yu's shoulder, she was her best friend for a reason and knew exactly how to calm her down. That was right, only a few more hours and this would be over. Aiden had fought his way through reporters and found them both, he immediately wrapped his arms around Mia and held her tight. Even his heart was beating out of his chest.
Aiden, "I love you, everything's going to be okay." Mia shook her head.
Mia, "I love you too but please don't hug me I'll cry." She chuckled, Aiden smiled in understanding and sat beside her. Words couldn't describe the support she felt from these who people it's like they had sucked the anxiety from her body and made her strong again.
Jane, "Sweetheart?" Mia sighed in relief and ran over to hug her mother, the two survivors were reunited ready to end the perpetrators life once and for all. Jane looked lovely in her suit, she even put on a little make-up she looked like a real businesswoman. Aiden and Yu also hugged her and started talking while Mia was taken away by her lawyer. It was safe to say he really looked the part too; he was around 40 but still looked so young. So, this was Aiden's friend.
"Nice to meet you my name is Li Wei; I'll be representing you today." His voice was so smooth and confident she thought.
Mia, "Mia it's nice to meet you. Thankyou so much for taking my case I'm very grateful." Le Wei smiled at her polite tone, he had black hair and bright brown eyes. Li had his head swept back neatly along with a law book in his hand, it was cliché and almost made Mia giggle, but she kept herself professional.
Li Wei, "It's my pleasure. Don't worry about anything I've been working on this for weeks; we have a good prosecution. You do not have to go on stand if you feel uncomfortable, I'll be with you the whole step of the way. Finally, I won't rest until he goes down for good." Li sounded very confident; Mia felt a little better about the case. However just as she was feeling at ease surrounded by family and friends the clerk called upon them.
Clerk, "We will be starting in a few minutes would you please take your seats." Aiden looked at Mia with worry seeing the colour drain from her face. Mia felt like she about to pass out, could she really do this. No…she had to do this, or this nightmare would never end.
Aiden, "Hey look at me, your okay." Aiden stroked her cheek to try and calm her, Yu and Jane took her hands. This was what she needed to do to be free and she would make damn sure the world knew how much of a monster this man was.
Mia, "I need to do this, or nothing will ever change. All of you…thankyou for supporting me I would never have gotten this far without you." They all were wide eyed seeing her sudden change in demeanour. Now she was standing proud with a genuine smile on her face, it was like seeing the real Mia for the first time since the attack. It was so shocking they almost started crying but held it together. Things were about to get very serious.
Side by side they all braced themselves as the clerk opened the door…it was so bright it took their breath away. Every seat apart from the front ones were filled with people who all turned in excitement to see the victim of the case. Mia took a deep breath and walked past them all ignoring their comments which were a mixture of judgments to say the least. Aiden, Jane and Yu all took the witness seats while Mia took the front and sat next to Li Wei who winked at her to say she was doing good. Catching her eye was the benches to the right, that was the defender's station where Sam would be sitting. Just the thought made her body shudder, but she didn't have time to falter now. Aiden tapped her shoulder and whispered in her ear.
Aiden, "Stay calm and professional, Li will handle it I have faith in you both. Good Luck." Mia nodded in determination; she wasn't only nervous, but she was pissed. This man had done this to her, anger was a better feeling than fear, so she focused mainly on that. As she settled in her seat drowning everything else out, the clerk led the defender called Gen Fu to the seats followed by the man in question. A mixture of disproving tongue clicks, and gasps filled the room as his handcuffs clinked down the aisle. Mia clenched her eyes shut and kept her head forward, he didn't even deserve her attention. Even though she payed him no attention whatsoever his gaze burned into her face. Yu and Jane both glared at him hatefully while Aiden smirked at him. He couldn't wait to see justice take this despicable man's life. Sam scowled at Aiden before returning his face to the front.
Bailiff, "All Rise! Department of Shanghai City Superior Court is now in session. Judge Jang presiding please be seated." A stampede of feet rose in response as the bailiff called the court into session. They all watched as the judge who was famous for controversial cases waltzed in proudly taking his seat.
Judge Jang, "Good morning Ladies and Gentlemen. Calling the case of Mia James versus Sam James. Are both sides ready?" Mia's district attorney Li Wei stood up.
Li Wei, "Prosecution is ready, Your Honor."
Gen Fu, "Defence is ready, your Honor."
Judge Jang, "Will the clerk please swear in the jury?" Mia watched the clerk who had welcomed them in walk over to the rows of people located to the right of the courtroom she had almost forgotten that the jury would be giving their verdict of the case. It was full of mixed men and woman from the city, they all looked composed and ready to hear.
Clerk, "Will the jury please stand and raise your right hand. Do each of you swear that you will fairly try the case before this court, and that will return a true verdict according to the evidence and the instructions of the court, so help you, God?"
Jury, "I do." They all answered in sync. These were the people Mia was residing on to prove his guilt. This was much more intense than she initially thought. Cameras were everywhere and the air was heavy. Aiden had mentioned this was a public case but didn't know it would be live coverage. Li Wei startled her as he stood up.
Li Wei, "Your Honor, as evidence we will be proving witness statements respondent of the prosecutors mother Jane James and Aiden Li who was present after the attack. We will also be providing evidence from the Shanghai City Police Department. Finally we will be providing evidence from Shanghai City hospital where the victims injuries were assessed. This includes statements and DNA evidence, that will be all."
Judge Jang, "Very well. Defence state your evidence."
Gen Fu, "Your Honor, we will be providing witness statements. That will be all." Mia looked at Li Wei who looked quite pleased, she wondered if he was nervous about their evidence. Mia wasn't stupid at all she knew exactly what was going on and was already beginning to plan different scenarios in her head. They all knew she was a victim, but they didn't know she was a genius.
Li Wei, "Your Honor and ladies and gentlemen of the jury: the defendant Sam James has been charged with the crimes of Assault in the first degree, Sexual assault in the first degree, Attempted Rape and finally attempted murder of the first degree. This was reported on the 17th of May at 12:04 am 2019. Sam James was arrested on 18th of May at 10:14 am after feeling the scene of the crime. The evidence I will present to you today will prove that the defendant is guilty as charged." Li sat down and noticed Mia's face, the charges must have reminded her. He tapped her knee and smiled to try and ease her. Mia jumped and smiled back; this was hurting a lot more than she thought…
Gen Fu, "Your Honor and ladies and gentlemen of the jury: under the law my client is presumed innocent until proven guilty. During this trial you will hear no real evidence against my client. You will come to know the truth that Sam James was wrongly accused by this woman." Li gave a odd glare to the defence council, it was subtle and Mia caught onto it too but Sam had a small smile on his face. They had something their sleeve and Mia knew it.
Judge Jang, "How does the defendant plead?" Mia lowered her head as Sam rose from his seat, the room went into an even deeper silence. Mia didn't know about his plea and neither did Li this was the first time Sam would be either lying or admitting to his crime. Mia's heart began beating faster, if he pleaded guilty that would cut the trial time in half making it easier on her family too.
Sam, "Not guilty, your Honor." Mia face dropped as she finally managed to look at him in rage, to her shock Sam was already looking at her. How could he not be guilty this wasn't right…unless…Sam had a trick up his sleeve. People began chatting and whispering but Mia was fixed on his smug little face. As their eyes met everything began flooding back. That night… that knife… his eyes everything.
Judge Jang, "Order! Defendant please defer eye contact with the victim." He said warningly seeing Mia becoming increasingly distressed. Aiden leaned over the seat and gripped her shoulder as her breaths became wheezy.
Aiden, "I'm right here it's okay. Just breathe Mia." Mia nodded and began her usual breathing exercises trying to expel the traumatic images from her mind she needed to pull it together and quickly.
Judge Jang, "Very well. First, I want to comment on some of the roles in this most important trial. Throughout this trial, you will be asked to be the judges of facts and I'll be the judge of law. Although I may comment on the evidence, as the judges of facts, you are the exclusive judges of evidence. By the same token, when I tell you what is the law is, it is my view of the law that must prevail." The jury nodded in agreement as the case continued.
Jude Jang, "Would the prosecution please present their first witness." Li Wei turned to Jane who looked surprised she was being called so soon. Mia looked at her mother sympathetically she could feel her nerves. Jane smiled at her daughter and nodded before taking the stand.
Li Wei, "Your Honor, I call Jane James to the stand." Jane avoided Sam's eyes at all costs and tried to focus just on Li, there was so many eyes on her she felt overwhelmed under the pressure.
Clerk, "Does the witness swear to tell the truth, the whole truth and nothing but the truth so help you god?"
Jane, "I do." Li Wei took his position at the centre of the space, Mia was tearful seeing her mother in such a position, but Jane was brave, one of the bravest people she had ever met.
Clerk, "State your name and address, Please."
Jane, "Jane James, 201 West Bank street."
Li Wei, "Mrs James could you explain to the court where you were when the events occurred on May 17th." Jane gulped and took a deep breath.
Jane James, "I was a resident in Shanghai Mental Health clinic at the time, I stayed in room 7 where the event occurred." A few people gasped to find she was present during the attack, but the defence still looked relaxed as ever.
Li Wei, "I see, Mrs James could you please explain what occurred on that night. Just take your time." Mia shuddered slightly, she had never really heard what happened before she got there and somehow, she felt so guilty. How could she forget what happened to her mother before, what sort of daughter was she?
Jane, "Yes. The clinic was closed at the time, usually there would be one nurse on call in the nurse's station that would do nightly checks on the patients. At around 11:30 pm I heard my door open, believing it was simply the night nurse I remained in bed."
Li Wei, "What happened next Mrs James." Jane's body language changed. Aiden could see Mia shaking listening to her mother's testimony and grew increasingly worried. If she was this distressed listening to her mother how would she cope if she was called to the stand?
Jane, "When the door didn't close right away, I looked up from my bed and that's when I was grabbed by my feet and dragged from the bed." It was sickly to hear such a thing and Mia's anger grew more and more.
Li Wei, "Mrs James, who dragged you from the bed?" Jane frowned before looking right into Sam's eyes with a grave expression.
Jane, "Sam James." She said bluntly, the judge began taking notes along with the jury, now this case was really in session.
Li Wei, "After the defendant dragged you from your bed what occurred after that?" Jane returned her attention to Li; it was strange that her fear suddenly disappeared. All she could think about was freeing her daughter from this burden she needed to take a stand as a mother.
Jane, "Sam proceeded to punch me several time while his accomplices tied up my arms and feet." Li Wei proceeded to point to the monitor next to the stand where it showed Jane's injuries. It was evidently clear she had rope burns on her arms and feet along with lacerations to her face and the inside of her mouth. The jury shook their heads shocked at her injuries. Mia covered her mouth and looked away from the screen feeling nauseous. Aiden rubbed her back as she tried desperately to stop retching.
Li Wei, "As you all can see the assault was quite vicious evident of Mrs James injuries." Jane refused to look but could feel people's sympathy towards her. All she could look at was Mia, who was trying so hard to keep it together.
Li Wei, "Mrs James, I would like to quote what the defendant said to you after the attack based on your police report." Jane nodded; she hated these words to her core, but she needed to tell the truth.
Li Wei, "This is what the witness heard the defendant say after the attack and I quote. Sorry about that auntie but you know she won't listen to me unless your life is on the line, you know how stubborn she is after all. Let's see how stubborn she is after I f*ck her once and for all." Everyone listened in disgust hearing the statement, this was too raw but necessary.
Jane, "Yes, that is what the defendant told me." Li smiled thanking her for her honesty before continuing the questioning.
Li Wei, "Now Mrs James after that you detailed in the police report that the defendant messaged your daughter telling her that you were at risk and if she did not come to the clinic, he would kill you."
Jane, "Yes, I remember him texting her before I lost consciousness." Li Wei nodded and quickly scanned through his notes.
Li Wei, "Your Honor we would like to request to resume this testimony at a later time based on the fact that Miss James lost consciousness at this point and her witness statement could possibly be uncredible." Jane knew it was a possibility the rest of her statement would be discarded, if she was unconscious the defence would manipulate anything she said further.
Judge Jang, "I'll allow it. Would the defence please begin their questioning?" Gen Fu stood up unbuttoning his jacket, he was a very plump man with very unattractive features, but he was well known for his success. Now was the hard part Mia thought Li was respectable, but Gen would most likely view Jane as an obstacle that needed knocking down.
Gen Fu, "Mrs James, is it correct to say you were a patient under Shanghai Mental Health clinic at the time of the attack?" Li's eyes twitched, so they were going down this road. This could be bad he thought, Mia also had a bad feeling in her gut.
Jane, "Yes, that is correct." Jane looked at Li who looked a little shook up, were they going to target her mental health?
Gen Fu, "Mrs James would you tell the court how long you were in the facility as well as your diagnosis."
Li Wei, "Objection your Honor, Relevance." Li tried to argue that this was not relevant to the evidence given but the Judge allowed the question…
Judge Jang, "Overruled, Mrs James please answer the question." Jane was scared to answer it was complicated.
Jane, "I was there for seven years. I was officially diagnosed with Bereavement Disorder at the beginning of this year." Gen Fu smiled slightly; she had given him the answer he wanted.
Gen Fu, "Your Honor we have evidence to suggest that Jane James's testimony is void in a court of law accountable of her sanity." Li Wei sighed; he knew this was coming. This was going to be a mess fight.
Judge Jang, "What evidence does the defence have to justify such a statement?" Mia watched Gen Li secretly glance at her as if antagonizing her.
Gen Fu, "Your Honor, we have Jane James's medical records present which show a history of mental illness. We would also like the court to be aware of the fact that Mia James is the clinician responsible for the report." At this point Aiden had to grab Mia's shoulders to keep her in her seat, they had overstepped the mark using her absence in their favour. They needed Mia's signature or that release but because she wasn't in work, they could have easily requested it. Mia was furious they were about to let her mother's struggles out into the world while also using her own words against her.
Mia, "You can't allow this, this is her personal information." Li Wei looked at her in defeat.
Li Wei, "If the judge finds it necessary to her testimony then we can't do anything. I had no idea they would do this. Please just stay calm." Stay calm! Mia was regretting her decision seeing Helen's face go pale, this was unfair to her. Mia looked at the judge pleadingly as he conversed with the clerk.
Judge Jang, "I will allow it, please proceed."
