I don't he doesn't really have to prove it, but there should be some sort of evidence before stringing him up. It feels so out of character for Rick to go along with this. Just killing or torturing without evidence will lead to a lack of confidence among the rest of the group. They might go around thinking that they will be next if they look at someone the wrong way, or if Shane feels like it. That's going to go downhill so fast...
