I found a lawyer that was willing to represent me in family court. I just wanted them out of those group homes.
*************
"Hi Avery and Jamie I'm Dale and I'll be representing you in court"
"Hi. So how exactly does this work?" I said
"Well you and Jamie will appear in family court as well as your sisters, and at the end the judge will decide wether or not to give you custody of your sisters"
"Ok"
We walk into the court room and I see a judge another lawyer, Amy and Scarlett, and their social worker. I hold Jamie's hand tight as we walk over to our bench.
"All rise"
We stand up and then sit back down. The other lawyer goes first.
"So this is really an open an shut case, that girl over there is a minor, she's 17. Meaning she's not a legal adult and hence can't take custody of her sisters"
"Dale?"
"She's and emancipated minor who has a good paying stable job, a loving husband, is currently going to therapy for her own mental health, and has an empty room in their apartment that can easily and comfortably fit Amy and Scarlett"
"That's another reason why she should take custody of these kids, she still a kid herself and already in therapy for her own issues"
"They is perfectly capable of taking care of Amy and Avery"
"The state has trouble with these two, what make you think their 17 year old sister can do any better"
"I'm glad you asked that, can Scarlett please step forward"
"Objection your honor relevance"
"Overruled, Scarlett step forward"
Just then I see Scarlett stand up and walk forward.
"Scarlett I know this is hard but can you roll up your sleeves and lift your shirt for the judge to see?"
She does it and we can see all the bruises on her body.
"This is what happened just one week in a group home. The other girls Ganges up on her and beat her up. She is obviously better off with her sister"
Scarlett walked back and everything continued. "Your honor that is just one group home, the next may be better. Also that group home is already under investigation for similar things"
"If it happened once it'll happen again" Dale said.
"How many times do these girls need to be beaten, starved and abused for the state to take accountability and accept that the living conditions in these group homes are not good"
"But we can't put them in the custody big their sister because she's still a minor" the judge said
"According to the law Avery Martin is legally and adult"
The judge think for a minute.
"If you can prove that these two girls will be better off with the sister, I'll allow it"
"Ok"
"This hearing is adjured"
We walk out, "So what now?"
"We win. Your obviously a more fit parent than the state ever could be, I'm confident you'll get your sisters."
We left the courthouse feeling hopeful, Scarlett and Amy went back to their group homes hopefully for the last time.
