Wizarding world is different from our world. They did endanger the statute of secrecy by flying out of the train, but since they didn't get seen by muggles, it wouldn't be a big deal. There's also the misuse of muggle articles, ie the flying car, but since they didn't get caught flying it, it was cool. Attacking a ministry employee on other hand, would land them in trouble, it doesn't matter if she attacked first. World isn't fair is it? But Dumbledore is quite powerful, both magically and politically. Everything related to Hogwarts and its students is handled by him usually, so I think it would come under school rules, since the witch would likely complain to the Headmaster before taking it up any further.
