Generally speaking, a patent for a pharmaceutical invention was valid for 20 years from the date of application. The fourth revision of the patent law passed on October 17,2020 came into effect on June 1,2021. It stipulated that in order to compensate for the time taken for the review and approval of new drugs, the patent administration department of the State Council would compensate the patent right duration upon the request of the patent holder for the invention patent related to new drugs that had been approved for marketing in China. The compensation period shall not exceed five years, and the total effective patent period after the new drug is approved for marketing shall not exceed fourteen years. Before China's patent law was revised in 1993, the term of protection for invention patents was 15 years, which was later extended to 20 years. At the end of 1992, the State Administration of Medicine issued the Regulations on the Administrative Protection of Pharmaceuticals, which granted administrative protection to pharmaceutical inventions made before 1993 for a period of seven years and six months. The regulations issued by the State Drug Administration on April 12, 1999 clearly stated that the protection period of Class I new drugs was 12 years, Class II and Class III new drugs were 8 years, and Class IV and Class V new drugs were 6 years (for new drugs with trial production period, the protection period included the trial production period). Read more exciting novels for free
