There's a lot of theories but I'm assuming Kisuke placed the Hyogoku inside Rukia during her mission that time and now is just prolonging her stay in the human world with the help of that gigai. Doesn't matter whether she give her powers to Ichigo or not, Aizen will still be able to imprison her cause he's controlling central 46. Aizen wants the Hyogoku and he'll find ways to implicate Rukia.
