Or say that he copied some jutsu like shadow clone by looking at handsigns (itachi copied fireball jutsu without sharingan) by looking at other jonin. As for water style jutsus he reinvented since it is nature + shape change.

Only problem I can see is that Tobirama will be much weaker than even the original (chunin exams time) one since it is Hiruzen who used the jutsu, not Orochimaru, who had improved the jutsu even more.

There are plenty of earth release jutsu that uses mud, like Jiraiya's swamp jutsu, Hiruzen's earth mud dragon (forgot the exact name), etc.
Some of these were relatively easier. For instance, Mud Release could have been placed in the first category if there was more information on it as it was very easy to explain how to create Mud by combining Water and Earth Release. - Shadow_Stryker27dCommented
