Dunno, strictly speaking I don't think either are right or wrong but I guess I would go with the shinigami as they were more morally correct. With Yhwach's ultimate goal of fusing the three worlds we would probably have witnessed consequences we don't know about. (aside from the obvious lack of death which he points out.)
