Well I just start to read them again so I can actually say why. It’s because of Arkham. If they were sent to blackgate which is the prison of Gotham they will be eligible but because they are deemed insane they don’t get the death penalty
Doesn't mean I am going to kill anyone though, that not practical or good for PR. Plus, as much as I hate to admit it, Batman has a point: killing is the easy way out and makes us no better then the criminals heroes go to capture. Is the justice system flawed on some level? Yes.
