I don't know how American law addresses this issue. But 13 is too young. In Brazil, the age of consent for sexual relations is 14 (and I still think this is very wrong) and the age for marriage is 16. But we are not talking about America or Brazil, as Harry Potter takes place in the United Kingdom, and there the age of consent is 16. Regarding the age difference, I personally follow the principle that I don't date anyone more than 3 years younger than me nor more than 7 years older.

The difference is that Percy is, in theory, a minor. At least that's what she thinks. If she knew he was of legal age, or if he had already finished Hogwarts, it probably wouldn't have been a problem. But minors are a problem everywhere.
