A good non-AU Fanfic expands the original story and builds upon it while adhering to the already established world and rules. One of the reasons why Harry Potter has so many Fanfic is because many things in the original are not clearly defined. So even if fanfiction writers make up it doesn't destroy the pre-established world. So writers have more creative liberty.
