If she goes to court with this I'm sure that she can prove that they r still legally married cuz they were so at the time of his disappearance, the guy is physically alive, no divorce. Moreover his identity as Ye Huo was completely legal. The ball is in the Gu family's court as to how they managed to establish Gu Yan's identity legally. But I think there is sufficient proof for Su Xi to prove that this guy only changed his official name n it doesn't discount him from any previous legal liabilities or responsibilities he may have. Also wouldn't he too have to establish in court that he is Ye Huo beyond reasonable doubt if he wants to assume guardianship over his children. Which court in the world will give custody of the children to a strange man while discounting his relationship with his wife. Not to mention that he doesn't have his memories now. So the separation between the married couple was not voluntary but imposed.

The Ye family was duped n her husband was literally attacked, kidnapped n stolen from her. Royal blood or an ordinary person, the same law applies to all of them. If Gu Yan wishes to pass on his business to his children he first need to prove in front of law that he is their biological father n that will automatically establish him as Ye Huo. N if this matter comes to light then the issue of his apparent death n disappearance will also come under legal scrutiny. Su Xi had to leave cuz of the threat to their lives so her father n brother who were to handle the funeral would also come under suspicion.
